Choreus Privacy Policy

This Privacy Policy explains how we collect, use, disclose and protect your personal information when you use Choreus. This Privacy Policy is incorporated into and forms part of our Terms of Use, which outline the terms and conditions you agree to when using Choreus. We will only collect, use and disclose your personal information in accordance with this Privacy Policy.

This Privacy Policy details how we comply with the Australian Privacy Act and the GDPR. If those laws give you extra rights, you have them.

By using Choreus and supplying your personal information, you acknowledge that you have read and understood this Privacy Policy, and that you agree and consent to the collection, use, disclosure and other processing of your personal information as outlined in this Privacy Policy. If you do not agree to our Privacy Policy, please do not use Choreus or supply your personal information to us.


Who we are

What personal information we collect and what we do with it

In this Privacy Policy, Personal information means any information about an identifiable individual. It does not include anonymous data which is not associated or linked to an individual or will not easily permit the identification of an individual.

The types of personal information we collect include:

  • Contact information such as your name, email address, contact preferences, or other contact information;
  • Device information such as your IP address, MAC address or operating system type;
  • Other personal information you voluntarily provide to us, such as the content of your communications with Choreus, including emails, video calls or other interactions with our Jacky Winter agents or tech support. An example of this is when you submit a production support enquiry or price check question to be answered by a Jacky Winter agent. Any information your provide is treated as confidential, and used only to the extent necessary to answer your question or provide you with the project support requested.

We use the personal information we collect in the following ways:

  • To provide you with access to Choreus and services requested by you, including our products, production support services and technical support. Except where you have expressly provided your consent or specifically requested it, Jacky Winter's agents and staff cannot view or access your practice data or any of your client, project, financial or other information.
  • To correspond with you about Choreus and its services, obtain feedback about Choreus, and to address any questions you ask about Choreus and its services;
  • To operate, maintain, improve and provide the features and functionality of Choreus.
  • To notify you of any Choreus news or updates (which you may opt out of receiving at any time by requesting we remove you from the mailing list or clicking unsubscribe);
  • To detect and prevent fraud, and to protect the safety of our Choreus users and Jacky Winter agents, intellectual property or other rights; and
  • To meet any legal or regulatory requirements.

Who we disclose your personal information to:

  • Our Related Bodies Corporate (as defined in the Corporation Act 2001 (Cth)) or other entities owned and/or controlled by our directors and/or shareholders;
  • Third parties who help with operating Choreus, such as financial service providers and technical support, for purposes of operating, maintaining, monitoring and analysing the Choreus web-app. Third Parties may only use your personal data for the purposes described in this Privacy Policy;
  • External counsel for the purpose of obtaining professional advice;
  • Any other third party with your express consent; or where we are required to disclose such information by law or to otherwise prevent harm.

We only collect personal data to the extent necessary to operate Choreus and for the purposes outlined above. Your personal information will not be used for any other purpose without your consent. If we ever want to do anything new with any of your personal information, it will be strictly opt-in and explained in plain English.

If we sell or transfer all or a portion of our business or assets to another party, your Personal Information will remain subject to this existing Privacy Policy unless you agree to the privacy policy of the new party.

Data Security and third party processors.

Our servers hosted by HatchBox, encrypted in transit and at rest.

Payment transactions are processed by Stripe. Stripe will collect payment information such as credit card details, Paypal account information from you as necessary to process your payment. Your payment information is encrypted and sent directly from your web browser to Stripe and is not stored by Choreus.

We are not responsible for the privacy practices or content of any third party processors or sites, please ensure you have reviewed and agree to the privacy policies for each third party processor or site.

We maintain appropriate technical and organisational security and confidentiality measures over your personal information and data. However, no system is 100% secure and as such we cannot guarantee the security of any information your provide us. Please take your own precautions to ensure that whatever you select for your use of Choreus is free of viruses or anything else that may interfere with the security of the data you provide.


Your Rights

You may request deletion of your account at any time. Upon deletion, we’ll make your data available for you to export for 30 days. After the 30 day period ends, your data will be purged after 30 days, except where we must keep it by law. Please note that once purged, your data will not be recoverable.

In accordance with the GDPR, we acknowledge the additional rights of EU users to:

  • have their data erased that is no longer being used for a legitimate purpose;
  • request a copy of all personal information held about them in a readable format, along with supplementary information to verify that such personal information is being processed lawfully;
  • And request restricted processing of their personal data whilst any complaints or concerns are being resolved.

Privacy Policy Updates

We may update this privacy policy from time to time. If we make a material change, we’ll notify you in-app. Your continued use of Choreus after notification of updated terms will be deemed as acceptance of those terms.
